Agreement to Terms

These Terms of Service ("Terms") constitute a legally binding agreement between you and Lux Boutiques ("Company," "we," "us," or "our") regarding your use of our e-commerce platform and services.

By accessing or using Lux Boutiques, you agree to be bound by these Terms. If you disagree with any part of these Terms, you may not access or use our services.

Services and Subscription

Service Description

Lux Boutiques provides an e-commerce platform enabling boutique owners to create online stores, manage products, process orders, and sell through multiple channels. Features vary by subscription tier.

Free Trial

We offer a 14-day free trial with full access to all features. No credit card is required to start your trial. At the end of the trial, you must select a paid plan to continue using the services.

Service Modifications

We reserve the right to modify, suspend, or discontinue any part of our services at any time. We will provide advance notice of material changes when possible.

Fees and Payment

Subscription Fees

• Essential Plan: ₹1,999/month (₹1,599/month if billed annually)
• Premium Plan: ₹2,999/month (₹2,399/month if billed annually)
• All prices are in Indian Rupees (INR) and exclude applicable taxes

Billing

You agree to pay all fees associated with your subscription:

• Monthly subscriptions are billed on the same day each month
• Annual subscriptions are billed in full at the start of each year
• Payment is processed automatically through Razorpay
• Fees are non-refundable except as provided in our Refund Policy
• Failed payments may result in service suspension

Taxes

You are responsible for all applicable taxes (GST, VAT, sales tax) associated with your subscription. Taxes will be added to your invoice as required by law.

Price Changes

We reserve the right to change our prices with 30 days' notice. Price changes will not affect your current billing cycle but will apply to subsequent renewals.

Cancellation and Refunds

You may cancel your subscription at any time from your account settings:

• Monthly Plans: Cancel anytime; access continues until the end of the current billing period
• Annual Plans: Cancel anytime; access continues until the end of the annual period
• 30-Day Money-Back Guarantee: Full refund available within 30 days of first payment

Acceptable Use

Permitted Use

You may use Lux Boutiques only for lawful business purposes to sell legitimate products and services.

Prohibited Activities

You agree NOT to:

• Sell illegal, counterfeit, stolen, or prohibited items
• Violate any intellectual property rights
• Engage in fraudulent or deceptive practices
• Transmit malware, viruses, or harmful code
• Attempt to breach our security or reverse engineer our software
• Use automated systems to scrape or access our services
• Impersonate others or misrepresent your identity
• Harass, threaten, or harm others
• Violate any applicable laws or regulations
• Resell or redistribute our services without authorization

Your Content and Data

Ownership

You retain all rights to your content (products, images, descriptions, customer data). We do not claim ownership of your content.

License to Lux Boutiques

You grant Lux Boutiques a limited license to use, store, and display your content solely to provide our services to you. This license ends when you delete your content or close your account.

Your Responsibilities

• You are responsible for the accuracy and legality of your content
• You must have rights to all content you upload
• You must comply with all product listing and advertising laws
• You are responsible for backing up your data

Content Monitoring

We reserve the right (but have no obligation) to monitor, review, or remove content that violates these Terms or applicable laws.

Intellectual Property

Lux Boutiques and its content (excluding your content) are protected by copyright, trademark, and other intellectual property laws:

• Lux Boutiques name, logo, and trademarks are our property
• Our platform design, code, and features are proprietary
• You may not copy, modify, or distribute our intellectual property
• You receive a limited license to use our services during your subscription

Third-Party Services

Lux Boutiques integrates with third-party services (Razorpay, Instagram, WhatsApp, etc.):

• Your use of third-party services is subject to their terms and policies
• We are not responsible for third-party services or their availability
• We may add, remove, or change third-party integrations at any time
• You are responsible for complying with third-party terms

Disclaimers and Limitations of Liability

Service "As Is"

Lux Boutiques is provided "as is" and "as available" without warranties of any kind, whether express or implied. We do not guarantee uninterrupted, secure, or error-free service.

Limitation of Liability

To the maximum extent permitted by law, Lux Boutiques shall not be liable for:

• Indirect, incidental, special, or consequential damages
• Loss of profits, revenue, data, or business opportunities
• Service interruptions or data loss
• Actions or inactions of third-party services

Our total liability shall not exceed the amount you paid us in the 12 months preceding the claim.

Indemnification
